Compliance Services Schedule

This is a Schedule to the General Terms of Unlimited Web Hosting UK Limited (t/a "1stDNS"). This Schedule applies to the Compliance Services defined below, and as stipulated in an Order.

Unless the context otherwise requires, the definitions used in the General Terms apply to this Schedule. Any other terms defined in this Schedule have that meaning for this Schedule only.

1. INTERPRETATION

In this Schedule, the following terms shall have the following meanings:

"Compliance Services" the services we provide to our customers by which we analyse and advise on PCI-DSS compliance requirements; and
"Compliance Services Fees" the fees payable to us by you for our provision to you of the Compliance Services.
"PCI-DSS" this means the Payment Card Industry Data Security Standard as defined by the PCI Security Standards Council.

2. COMPLIANCE SERVICES

2.1 What we provide: The Compliance Services are to provide you with our advice on what, if any, level of security hardening may be required for the testable endpoint (which may be a Server) to remediate any failings concerning a PCI-DSS compliance test against that endpoint conducted by a competent authority, however we will not undertake such security hardening may be required for the testable system. We do not provide a PSS-DSS compliance test in any capacity as part of the Compliance Services, and such must be independently obtained by you for use in conjunction with the Compliance Services by a competent authority, as must any subsequent re-tests against the testable endpoint.

2.2 Exclusions: We do not provide Compliance Services as part of any other Service, the Compliance Services are separately contracted as part of an Order and for specific and non-recurring use in relation to testable endpoint.

2.3 No warranty: We do not warrant that, in providing the Compliance Services, the relevant testable endpoint be capable of passing the PCI-DSS compliance test at any particular point in time, however we will use our reasonable efforts and skill to provide such guidance as to what action may be required in respect of the testable endpoint in order to remediate any failings concerning a particular PCI-DSS compliance test. We cannot guarantee that guidance will remain valid following the delivery of the Compliance Services. You acknowledge that PCI-DSS compliance requirements are constantly changing and a testable endpoint that is compliant at a certain point in time may become non-compliant as requirements change unless further testing and improvement is undertaken.

3. COMPLIANCE SERVICES FEES

3.1 Compliance Services Fees: The Compliance Services Fees are as set out on the Website at the time that you submit your Order, subject to Clause 10.3.

4. TERM

4.1 Term of this Schedule: This Schedule shall commence on the date of the relevant Order Acceptance and, unless terminated earlier in accordance with the termination provisions under this Agreement, shall continue in full force and effect until the latest of:

4.1.1 the completion of the provision of the Compliance Services in accordance with this Agreement; or

4.1.2 the conclusion of payment of all sums due under this Schedule.
